The terms of placing a game idea on the Daily Board: what the money buys, that it is final, and what the studio commits to.
# Daily Board Placement Terms
These terms are the contract between you and the operator of the Daily Board whenever you post an idea on the board or add money to one. Read them with the Board Rules, the Content Policy and, if you add brand assets, the Asset Terms. The Terms of use of https://stigmera.games continue to apply to your use of the site and to the text of your idea.
## 1. Parties
The board is operated by the individual who operates Stigmera Games, the Republic of Kazakhstan ("we", "us"). Contact: [email protected]. Today the operator acts as an individual and not as a registered business; when the operator registers as a sole trader in the Republic of Kazakhstan, a new version of these terms will carry the registration details, and it will apply to contributions made after it takes effect.
"You" means the person who posts an idea or makes a contribution. You must be at least 18 years old. You may act as a consumer or for a business; if you act for a business, you confirm you may bind it.
## 2. The service
For every contribution we provide, at once:
1. placement of the idea on the board for the current round, with its running total; 2. your display name among the idea's backers; 3. a mention at the scheduled board readings on the stream; 4. an entry in the round archive.
The rank of an idea is computed from the totals, as the Board Rules describe. Being outranked is how the board works and is not a defect of the service. We promise no traffic, viewers, clicks or other outcome.
Ideas and assets you send to the board are not returned. The Terms of use of https://stigmera.games say how we may use the text of an idea, and the Asset Terms say the same for brand assets.
## 3. Contributions are final
The service starts immediately and is complete when the idea appears on the board with your contribution. **A contribution is not refunded because the idea was outranked, because the round closed, or because the idea was not built.** There is no chance element and no draw, the money is not pooled, and nothing is paid out to anyone taking part.
## 4. Your right of withdrawal
If you are a consumer with a right of withdrawal (for example in the European Union or the United Kingdom), you expressly request that the placement starts immediately, and you acknowledge that you lose your right of withdrawal once the service has been fully performed — at the latest when the round closes. You confirm this with a separate checkbox before paying; we repeat it in the receipt e-mail together with the version of these terms.
## 5. The build of the top-ranked idea
When a round closes, the top-ranked eligible idea is built live on the next stream, subject to the Board Rules and the Content Policy. If it is not eligible and is not fixed by the start of that stream, the next eligible idea of the round is built instead, and the skipped idea moves into the next round with its total, once.
The scope is one small browser game that we judge feasible in one stream. Design decisions are ours, and there are no revisions. We deliver the build by publishing it on https://stigmera.games and by sending the Build Licence to the backer of the idea within 48 hours of the stream. If the build does not reach a finished state on the stream, we publish what exists, marked as unfinished, and the Build Licence still applies.
## 6. Payment
While payments go through Buy Me a Coffee, you pay the operator on the Buy Me a Coffee page of the board's shop item and type the idea code in the required question. Buy Me a Coffee's own terms apply to that payment, and card fees may be added at checkout. The amount placed on the idea is the amount of the payment in US dollars.
When payments move to our own checkout, you will pay on https://stigmera.games; the charge may be made in Kazakhstani tenge at the rate shown at checkout. A new version of these terms will say so before the change applies.
A payment counts when it reaches the board. If it cannot be matched to an idea (for example, the code is missing), write to us with the e-mail address you paid with and the code you meant, and we will place it by hand.
## 7. Chargebacks
A chargeback or payment dispute without a good reason ends your participation in the board and withdraws any Build Licence connected to the contribution. We may reverse the contribution on the board and recompute the ranks. A build that was already delivered is not undone.
## 8. Removal
We may hide or decline any idea, name or asset that breaks the Content Policy, the Asset Terms or the law, or that we are asked to remove on a credible legal ground. A contribution to an idea removed for such a reason is not refunded. If an idea is removed because of our own mistake, we may refund at our discretion.
## 9. Your data
Your display name is public on the board, in the archive and on the game page. Your e-mail address is private: we use it to send receipts and messages about your ideas and to match payments. For every placement we keep the versions of the documents you accepted, the time, your IP address and your browser's user agent, as evidence of this contract. We keep the payment records as long as tax law requires. The privacy policy of https://stigmera.games explains the rest.
## 10. Liability
To the extent the law allows, our liability for anything connected with the board is limited to the amount you contributed in the round concerned. Nothing in these terms limits a liability that cannot be limited by law.
## 11. Law, language and changes
These terms are governed by the law of the Republic of Kazakhstan. They are written in English; if a translation differs, the English text applies. We may change these terms with notice on the board; a contribution stays under the version you accepted when you made it. If a clause is invalid, the rest remains in force.
